Pursuant to Hawaii Revised Statutes (HRS) Chapter 91, notice is hereby given that the State Public Charter School Commission (SPCSC), will hold a public hearing to hear all persons interested in the adoption of new regulations in Title 8, Hawaii Administrative Rules (HAR), as follows:
Amend Chapter 8-501 State Public Charter School Commission Rules of Practice and Procedure to add the definition of “Executive director” to enable the Commission to delegate its authority to the executive director to enact the process regarding proceedings before the commission.
Promulgate new Chapter 8-502 State Public Charter School Commission Proceedings Before the Commission to provide for the process and procedures for proceedings before the Commission. These rules then establish the process by which the Commission may further create the process for rulemaking also being promulgated in new Chapter 8-503.
Promulgate new Chapter 8-503 State Public Charter School Commission Rules Applicable for Rulemaking Proceedings. These rules provide the process by which the Commission may make new rules in the future and the rules for making such rules.
PUBLIC HEARING SCHEDULE
The public hearing will be held on Monday, November 20, 2017 at 2:00 p.m. to 4:30 p.m. at the State Public Charter School Commission, Conference Room located at the Remington College Building, 1111 Bishop Street, Suite 516, Honolulu, Hawaii, 96813. To participate via WebEx click here.
All interested persons shall be afforded the opportunity to submit data, views, or arguments, orally or in writing, on the proposed administrative rules at the time of the public hearing. Persons wishing to submit written testimony are requested to file via email (email@example.com) their written testimony by 4:30 p.m. on Monday, November 13, 2017. By the same date, written testimony may also be submitted by mailing at least three (3) copies to the State Public Charter School Commission at 1111 Bishop Street, Suite 516, Honolulu, Hawaii, 96813.
Persons who will require special assistance or services, such as a sign language interpreter, at the public hearing are invited to call (808) 586-3775 or via relay, at least ten business days before the public hearing.
Decision-making on the proposed administrative rules will take place at a properly noticed meeting of the Commission. The date and time of the decision-making meeting will be announced at the public hearing. No testimony will be taken at this decision-making meeting.
AVAILABILITY OF COPIES OF THE PROPOSED RULES
The proposed rules may be viewed below and downloaded free of charge or viewed on the Lieutenant Governor’s website at http://ltgov.hawaii.gov/the-office/administrative-rules/proposed-changes/.
The proposed rules may also be reviewed in person free of charge between 7:45 a.m. to 4:30 p.m., Monday through Friday, excluding State and federal holidays, at the Commission’s office at 1111 Bishop Street, Suite 516, Honolulu, Hawaii, 96813.
A copy of the proposed rules may be picked up at the above address during the days and hours of operation listed. A copying fee of 10 cents per printed page will be assessed upon pick up of the proposal resulting in a cost of $0.30 for Chapter 8-501, HAR, entitled "State Public Charter School Commission Rules of Practice and Procedure," and $0.60 for Chapter 8-502, HAR, entitled "Proceedings Before the Commission,” and $0.50 for Chapter 8-503, HAR, entitled “Rules Applicable to Rulemaking Proceedings.”
A copy of the proposed rules may also be mailed to any person who requests a copy. Copying and postage costs result in a cost of $0.79 for Chapter 8-501, HAR, entitled "State Public Charter School Commission Rules of Practice and Procedure," and $1.09 for Chapter 8-502, HAR, entitled "Proceedings Before the Commission,” and $0.99 for Chapter 8-503, HAR, entitled " Rules Applicable to Rulemaking Proceedings.” The request must be submitted in writing to the State Public Charter School Commission, 1111 Bishop Street, Suite 516, Honolulu, Hawaii, 96813, and include mailing and contact information for the requestor and the required payment, as noted above for the proposed rule, in the form of a check made payable to “State Public Charter School Commission.”
