Essential Terms

On July 2, 2013, Alison Kunishige distributed to the charter schools NACSA's comments on each respective school's Essential Terms. Commission staff also reviewed and provided additional comments for some of the Essential Terms. Schools have been asked to review the comments and revise the Essential Terms accordingly. This memo explains the terms that NACSA used as part of their comments.

 

Changes to the Essential Terms will be considered contract amendments since they are a part of the Exhibit A (Educational Program) of the charter contract. However, schools will not have to go through the full contract amendment process for these Essential Terms amendments because the Commission did not formally approve the Essential Terms when it approved the Exhibits A for the 2013-14 school year charter contracts. Instead of submitting the Charter Contract Amendment Form (which would ordinarily be required under the full contract amendment process), schools just need to let staff know whether the school’s Essential Terms represent a change in any way from the program described in the school’s original application. If there is a change, schools need to describe the change. Staff may contact schools for further information, if necessary.

 

Exhibit A of the charter contract can be amended at any time during the 2013-14 school year, but schools are being encouraged to amend their Essential Terms in accordance with the schedule below.  The schedule takes into consideration the timing necessary to get the documents submitted to the appropriate Commission Committee as well as the full Commission and also allows for additional feedback from staff before submitting the revisions to the Commission.

 

July 26

Deadline to submit revised Essential Terms and description of any program changes to Commission staff for preliminary review and comment.

 

August 5

Deadline for schools to submit Essential Terms and description of any program changes to Commission staff.

 

August 15

Essential Terms that have been sufficiently revised put on Commission Committee agenda as a contract amendment.

 

August 22

Commission Committee meeting held to take action on Essential Terms on agenda.

 

September 12

Charter Performance Contracts Executed

July 2, 2013

On July 1, 2013, the fully executed 2013-14 charter contract terms began. The Commission distributed digital copies of each charter contract to its respective school. The Commission published a news release which can be read on our Charter School News page.

Charter Contract Amendment Process

June 21, 2013

On June 13, 2013, the Commission approved these procedures for requesting amendments to Exhibit A (Educational Program) and Exhibit B.3 (School-Specific Measures) of the charter contract.
